Current laws and regulations on the apportionment of areas

At present, in the actual daily operations, the policy basis related to land rights registration is:

(1) Article 5 of the Land Registration Rules states: "Land registration shall be the basic unit of land registration. If more than two land users jointly use one land, they shall apply for registration separately."

(2) Article 21 of the "Law of the People's Republic of China on the Administration of Urban Real Estate"5: "If the period of use stipulated in the land use right transfer contract expires and the land user needs to continue to use the land, it shall apply for renewal no later than one year before the expiry date. In the period, except for the need to recover the land in accordance with the public interest, it shall be approved. If the renewal is approved, the land use right transfer contract shall be signed again and the land use right transfer fee shall be paid in accordance with the regulations."

(3) Article 8 of the "Jiangsu Province Land Registration Regulations" states that "land registration is based on parcels as the basic unit." "The so-called parcels are lands that are enclosed by land boundaries. Use of two or more lands." The land that is difficult to distinguish between the ownership lines is also known as the parcel.” “If a land right holder owns or uses two or more lands, it should be registered separately; two or more lands must be used. If a person shares a land together, they should be registered separately."

(4) The Ministry of Land and Resources's reply 6 on the issues related to the registration and issuance of underground building land rights clearly stated: “All underground buildings that are integrated with buildings on the ground, their land rights can be determined as land use rights. When registering, the building area of the underground building is included in the total building area, and then the area of land on the ground is apportioned according to the ratio of the underground building area owned by the right owner to the entire building area. The underground building integrated with the buildings on the ground can be defined as land use rights (underground). When it is specifically registered, its land area is the vertical projected area of the underground buildings, and the corresponding land use is indicated in the Remarks column. The characteristics of the rights: Land use rights (underground) can be rented, transferred, and mortgaged without violating the use and conditions of use of underground buildings."

It can be seen that in the land use rights, the determination of land area is very critical. In this way, we need to use certain instruments such as area measuring instruments. The area measuring instrument has a GPS positioning function and has the functions of measuring land area, length and width, and is also widely used in agriculture. The acremeter and harvester area measuring instrument is the application of the area measuring instrument in the measurement of agricultural farmland area. At this time, they measure the land area and promote the agricultural production.
